Can I be arrested for a drug charge if there is more than one person in the car and no one admits to the drugs?

Return to FAQ Videos

Transcript:

You can be arrested for a drug charge if there’s drugs found in the car with other people in it, even if no one admits to ownership of the drugs. Typically, if drugs are found in the center console or on the floorboard, it gives law enforcement probable cause to arrest everyone in the car. However, there is a difference between arresting everyone and proving your guilt beyond a reasonable doubt. If the drugs are found in the car, there’s more than one person in the car, and no one admits to ownership, it makes it very, very, very difficult for the police to prove that case beyond a reasonable doubt.
