In March 2026, an undercover officer contacted an alleged drug dealer and met up with him in the backseat of a car parked outside a storage unit. The exchange of drugs led to the arrest of the alleged drug dealer and the dealer’s brother, who was not in the car at the time of the drug buy. Police also arrested the father and son, unrelated to the two brothers, who were in the front seat of the car at the time of the purchase, as well as the roommate of the two brothers, who was not in the car at the moment of truth.
Each of the five defendants is presumed innocent until proven guilty. The arrests happened after police investigated for almost two years. They identified one apartment in Miramar, the one where the two brothers and their roommate live, as a trap house, where drug purchases take place. They also searched another apartment that they allege that the defendants were using as a stash house, where they would store drugs.
There is plenty of room for reasonable doubt in complex prosecutorial narratives. Was there really probable cause for the police to search one or both of the apartments? Does simply being in a car where a drug deal happened or living in a shared apartment where there are illegal drugs make you guilty?
