Will a Drug Conviction Affect Your Driver’s License in Florida?

Under Florida Statute Section 322.055, a conviction for drug possession, sale, trafficking, or conspiracy to do any of the above triggers an automatic suspension of your driver’s license. We’re talking about a suspension even if the drug offense had absolutely nothing to do with a car or driving. You could have been sitting in your living room, and Florida law still considers your driving privileges fair game.
Here’s what that can look like in practice:
- A six-month suspension for adults 18 and older who have a valid license at the time of conviction
- A two-year revocation if your license was already under suspension or revocation for any reason when the drug conviction happened
- A delay in getting your license at all if you’re of age but don’t yet have one
- After six months, the option to petition for a restricted license for business or employment purposes
Doesn’t exactly scream “fresh start.” And remember, this is on top of whatever else comes from the criminal case itself.
What About Getting Your License Back?
Florida does allow you to petition for reinstatement after a minimum of six months of your suspension period has elapsed. One possible path back is completing a drug treatment and rehabilitation program approved by the Department of Children and Families. If the court directs it and you complete the program, you may become eligible for reinstatement. But again, none of this is automatic. There are hoops. There are timelines. And there’s no guarantee.
