In many ways, the New Year’s Eve arrest of Frank Venegas in Collier County on drug charges was just a typical day. You might even call it a stereotypical Florida incident. Venegas, 24, is one of the two performers who post videos of their music on Tik Tok under the stage name “Island Boys,” but everyone is a Tik Tok celebrity in Florida. The arrest happened because of a trivial event that led to another trivial event, but because Venegas has prior involvement with the criminal justice system, he could face serious legal trouble. In typical Florida fashion, what started out as being about a single sleeping pill that barely counts as a controlled substance ended up being about fentanyl. As with any criminal charges, including but not limited to those that arise from traffic stops, Venegas and his co-defendant are presumed innocent until proven guilty, and they have the right to due process of law. Does Fidgeting Count as Probable Cause for a Traffic Stop?

Olivia Bubois and Frank Venegas set out to have an uneventful New Year’s Eve, but a minor traffic infraction changed everything. They went to a Circle K gas station on SR-29 in Collier County, but when Dubois reached the intersection of Kaicasa Lane, she did not stop her car before the crosswalk; even though there were no pedestrians in the crosswalk at the time, a police officer saw her and pulled the car over. As the officer approached the car, he saw Dubois and Venegas, who was in the passenger seat, fumbling with miscellaneous items near the center console. When he asked why, Dubois said that it was because she knew that the officer would need to see the vehicle registration, so she and Venegas were looking for it.

The officer considered their behavior suspicious and searched the car. The search yielded a pill bottle in which all the pills had been prescribed to Dubois, except one, a Zolpidem pill. Zolpidem, a prescription sleep medication known by the brand name Ambien, is a Schedule IV controlled substance. Police also found a small bag of drug powder in the car, and it turned out to be fentanyl.

Dubois is now facing criminal charges for drug possession. Venegas has even bigger legal problems, though. At the time of the arrest, he was out on bond for a pending case involving illegal possession of weapons. Therefore, he is accused of violating the conditions of his bond; the allegations seem to be that the drugs belonged to Dubois.
