Drugs were found in my car, but they are not mine. I was arrested. Do I need an attorney?

Return to FAQ Videos

If you’re arrested for drugs being found in your car, even if they weren’t yours, yes, you need an attorney. The police can still arrest someone for anything that’s found in their car, but they also have to prove that you had knowledge of those drugs. So if they truly were not yours, if you didn’t know about them, if you didn’t make any statements admitting to knowledge of them, then the state has a heavy burden to prove that against you, but can you still be charged? Yes. And do you still needed a lawyer? Yes. You do.
